Scope - The scope for this Work Group includes evaluating legal issues in the creation, collection and return of Substitute Checks and Image Exchange. The Legal Work Group will aid in the understanding of how Check 21 and Image Exchange operating and business processes impact the legal environment. This includes reviewing current regulations, rules and other agreements.

Objectives and Deliverables - This Work Group will review current issues and practices, including:

• Returns vs. Adjustments
• Return Consolidators
• Non-conforming Substitute Checks
• Indorsements
• As it relates to standards
• Ability to vary Reg CC Appendix D?
• Retention of original check
• Reg CC availability for remotely captured checks
• Image RCC - RCC never existed in paper form
• Intentionally destroying MICR line
• Modification to Image characteristics
• Rational of non-return of original check to customer
